Topic 3

Lord Denning was judge,he has been very important for British law because of the many cangements he brought to judicial system, during his life.He instigated important concepts that would become pillars of the common law,and others that have been rejected in the house of lords, likethe doctrine of fundental breach.
He made famous decisions in his court during his 38 years of career.
In 1997 he received the Order of Merit.
In 1957 he became a Lord of Appeal in Ordinary with a life peerage as Baron Denning, of Whitchurch in the County of Southampton. He served until 1962. In the House of Lords, Denning found him often disagreeing with the other judges, and delivering dissenting opinions. In particular, there appeared to be some animosity with Viscount Simonds , known as a rather orthodox and conservative judge. In Rahimtola v.Nizam of Hyderabad in 1958 their disagreement became public. Simonds gave a magisterial rebuke against Denning for citing cases not mentioned by counsel or courts below. Later,Denning's decision was followed. The animosity between Denning and Simonds could also be seen in Denning's dissenting opinion in Scruttons v.Midland Silicones , full of cutting irony over the privity doctrine. In 1963, Denning was appointed by then Prime Minister Macmillan to look into the role of the police and security services in the Profumo affair. However, much of his report was devoted to an investigation of S.Ward, a man whom Denning alleged had catered for the "perverted tastes" of others. However, Ward was a relatively minor player in the affair. His only relation to it was in introducing the then Secretary of State for War Profumo to Keleere, with whom Profumo subsequently became intimately involved.Conspiracy theorists have insinuated that Denning was involved in a cover-up to protect members of the establishment — allegedly including members of the royal family — from being pinned as the culprits.Denning was known for challenging the principle of Stare decisis (binding judicial precedent) .
He diedat the age of 100.
